 Regulations of Shanghai Municipality on WorkSafety

第一章  总则

Chapter IGeneral Provisions

第一条 为了加强本市安全生产监督管理,防止和减少生产安全事故,保障人民群众生命和财产安全,促进经济发展和社会稳定,根据《中华人民共和国安全生产法》和其他有关法律、行政法规,结合本市实际,制定本条例。

Article 1

These Regulationsare enacted for enhancing supervision and control over work safety in this city,preventing accidents due to lack of work safety and keeping their occurrence ata lower level, ensuring the safety of people's lives and property and promotingthe development of the economy and the stability of society, in accordance withthe Law of People’s Republic of China on Work Safety and other relevant lawsand regulations, based on the actual situation of this Municipality.

第二条 本市行政区域内生产经营单位的安全生产及其相关监督管理活动,适用本条例。有关法律、法规对消防安全、道路交通安全、铁路交通安全、水上交通安全、民用航空安全等另有规定的,适用其规定。

Article 2

These Regulationsare applicable to work safety in units that are engaged in production andbusiness as well as  relevant supervisionand administrative activities within the territory of this Municipality. Wherethere are other provisions in relevant laws and administrative regulationsgoverning fire fighting, road traffic safety, railway traffic safety, water waytraffic safety, those provisions shall apply.

第三条 安全生产管理应当以人为本,坚持安全第一、预防为主、综合治理的方针,实行政府领导、部门监管、单位负责、群众参与、社会监督的原则。

本市建立和健全各级安全生产责任制。

Article 3

The worksafety administration shall be people-oriented, uphold guidelines of givingfirst place to safety and laying stress on prevention as well as comprehensivetreatment, and implement principles of government leading, sectoradministration, unit responsible, mass participation and society supervision.

The systemof work safety responsibility shall be established and improved in thisMunicipality.

第四条 生产经营单位是安全生产的责任主体。

生产经营单位主要负责人对本单位的安全生产工作全面负责;分管安全生产的负责人协助主要负责人履行安全生产职责;其他负责人应当按照各自分工,负责其职责范围内的安全生产工作。

Article 4

Work safetyunits are responsible subjects of work safety.

The Principalresponsible of production and business units shall be full in charge of worksafety of their own units. Responsible in charge of work safety shall assistprincipal responsible to implement the duties of work safety. Other responsibleshall be in charge of work safety within the duties in accordance with the workdivision.

第五条 从业人员依法享有平等获得安全生产保障的权利,并应当依法履行安全生产方面的义务。

Article 5

Employeeshave the right to work safety assurance in accordance with law, and they shall performtheir duty in work safety in accordance with law.

第六条 市和区、县人民政府应当加强对安全生产工作的领导,建立和完善安全生产监控体系、责任制度和考核制度,并将安全生产工作纳入国民经济和社会发展规划以及年度工作计划。

市安全生产委员会负责研究部署、统筹协调本市安全生产工作中的重大事项,并根据有关法律、法规和规章的规定,编制成员单位安全生产工作职责,报经市人民政府批准后执行。

乡、镇人民政府和街道办事处按照本条例规定,做好本辖区内相关的安全生产监督工作。

Article 6

The municipal, district and county people's governmenthall strengthen their leadership over work safety, establish and perfect the supervision,responsibility and examination system of work safety,  and put the work safety in the planning ofnational economic and social development, as well as annul work plan.

The MunicipalWork Safety Committee shall be responsible to study and arrange, wholly planand coordinate major matters of work safety in this Municipality, and draft thework safety duty of member units in accordance with relevant law, regulationand rule, filing for approval before the Municipal People’s Government and thenexecuted.

Town-levelPeople’s government and neighborhood committee shall carry out relevant worksafety and supervision in their own territories in accordance with provided inthese Regulations.

第七条 市和区、县安全生产监督管理部门(以下简称安全生产监管部门)对本行政区域内的安全生产工作实施综合监督管理,履行下列职责:

(一)会同有关部门编制、实施安全生产专项规划;

(二)指导、协调和监督同级人民政府有关部门和下级人民政府履行安全生产工作职责;

(三)依法对生产经营单位的安全生产工作实施监督检查;

(四)按照法律、法规和规章的规定,对涉及安全生产的有关事项实施审批、处罚;

(五)根据同级人民政府的授权或者委托,组织、协调、指挥安全生产应急救援,组织生产安全事故调查处理;

(六)法律、法规规定的其他职责。

Article 7

The departmentin charge of supervision and control over work safety under the Municipal,district and county People’s government (hereinafter as the “work safetysupervision department”) shall exercise all-round supervision and control overwork safety within the territory, fulfilling the following duties:

1)    Draft and implement special plan of work safety, together withrelevant departments;

2)    Guide, coordinate and supervise that the relevant departments ofthe same-level people’s government and lower-level people’s government fulfillthe duty of work safety;

3)    Supervise and examine the work safety of production and businessunits in accordance with the law;

4)    Approve and punish the matter concerned to work safety inaccordance with the law, regulation and rule;

5)    Organize, coordinate and direct emergency rescue of work safety,and organize investigation and treatment of work safety accidents.

6)    Other duties provided by the law and regulation.                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                                           

第八条 本市公安、建设、质量技术监督、交通港口等依法对涉及安全生产的事项负有审批、处罚等监督管理职责的部门(以下统称专项监管部门),应当严格按照有关法律、法规和规章的规定,实施安全生产专项监督管理。

其他有关部门在各自职责范围内,做好有关的安全生产工作。

Article 8

Thedepartment with supervision and administration duty of approval, punishment,etc., concerned to work safety in accordance with the law, such as  public security, construction, quality andtechnical supervision, transportation port and so on(hereinafter as the “specialsupervision department”), shall exercise special supervision and control overwork safety, strict in accordance with the relevant law, regulation and rule.

Otherrelevant departments shall exercise the work safety within the scope of theirrespective responsibilities

第九条 各级工会依法组织从业人员参加本单位安全生产工作的民主管理,对本单位执行安全生产法律、法规等情况进行民主监督,依法参加事故调查,维护从业人员在安全生产方面的合法权益。

Article 9

Work unionsat all levels shall, in accordance with law, make arrangement for employees toparticipate in the democratic management of and supervision over work safety intheir units, and to carry out the democratic supervision of the situation intheir units when implementing the law and regulation of work safety,participate in the accident investigation in accordance with law, safeguardingthe legitimate rights and interests of the employees in work safety.

第十条 各级人民政府及其有关部门应当采取多种形式,开展安全生产法律、法规和安全生产知识的宣传教育,增强全社会和从业人员的安全生产意识以及事故预防、自救互救的能力。

报刊、广播、电视、网络等单位有进行安全生产宣传教育的义务,有对违反安全生产法律、法规的行为进行舆论监督的权利。

Article 10

People's governments at all levels and the relevant departmentsunder them shall, in all kinds of forms, publicize laws and regulationsregarding work safety and disseminate knowledge about it, in order to enhancethe employees' awareness of the importance of work safety, and the ability ofaccident prevention and self-help and mutual aid.

The units, such as newspaper and magazine, broadcast, television,internet, etc., is obligated to publicize the work safety, and is entitled to conduct public opinion on the actsviolating work safety law and regulation.

第十一条 市和区、县人民政府及其有关部门应当鼓励安全生产科学技术研究,支持安全生产技术、装备、工艺的推广应用,扶持技术含量高、社会效益好的安全生产科技项目和相关生产经营单位,提高安全生产技术水平。

Article 11

The municipal, district and county people’s governments andrelevant departments under them shall encourage the scientific and technicalstudy on work safety, support the promotion and application of work safetytechnology, equipment and skills, aid the work safety technical project withhigh technology element and good social benefit, as well as relevant productionand business units, improve the technical level of work safety.

第十二条 本市推进安全生产社会化服务体系建设,支持有关中介服务机构依法开展安全生产评价、检测、检验、培训等活动。

从事安全生产评价、检测、检验、培训等活动的中介服务机构,应当具有法律、行政法规规定的资质,并依法对其提供的服务承担责任。

Article 12

The social service system of work safety will be propelled andconstructed in this Municipality, and the intermediary organizations aresupported to carry out assessment, detection, check, trainings on work safetyin accordance with law.

 The intermediaryorganizations providing assessment, detection, check, trainings on work safety,shall hold the qualification required by the law and regulation and take theliability on their service provided in accordance with the law.

第二章  生产经营单位的安全生产保障

Chapter II Work Safety Assurance inProduction and Business Units

第十三条 生产经营单位应当具备法律、法规和强制性标准规定的安全生产条件。不具备安全生产条件的,不得从事生产经营活动。

生产经营单位应当遵守下列安全生产规定:

(一)生产经营场所和设施、设备符合安全生产的要求;

(二)建立安全生产规章制度和操作规程;

(三)保证安全生产所必需的资金投入;

(四)提供符合国家标准或者行业标准的劳动防护用品;

(五)设置安全生产管理机构或者配备安全生产管理人员;

(六)主要负责人和安全生产管理人员经安全生产培训、考核合格;

(七)从业人员经安全生产教育和培训合格,特种作业人员经专门的安全作业培训,并取得特种作业操作资格证书;

(八)采取职业危害防治措施。

Article 13

  Production and business units shall have the conditions forwork safety as provided in the law, regulations and mandatory standards. Productionand business units that do not have such conditions are not allowed to engagein production and business activities.

Productionand business units shall comply with the following rules of work safety:

1)    Production and business location and facilities, equipments meetthe requirements  of work safety;

2)    Establish the regulation system and operation procedure of work safety;

3)    Make sure the capital investment necessary for work safety;

4)    Provide work protection articles complying with the national andindustrial standards;

5)    Set up management organization of work safety or provide themanagement staff of work safety;

6)    Principal responsible and work safety management staff are trainedon work safety and are qualified;

7)    Employees are qualified in work safety education and training, andthe special workers get the special operation qualification certificate after specialwork safety training;

8)    Take preventive measure on occupational hazards.

第十四条 生产经营单位主要负责人应当履行《中华人民共和国安全生产法》和其他法律、法规规定的职责,定期研究安全生产问题,向职工代表大会、股东大会报告安全生产情况,接受安全生产监管部门和有关部门的监督检查,接受工会、从业人员对安全生产工作的民主监督。

Article 14

The principalresponsible of production and business unit shall exercise the duties providedby the Law of People’s Republic of China on Work Safety and other law andregulation, study the work safety problems regularly, report the work safetysituation to workers’ congress and shareholders meeting, accept the supervisionand examination from work safety supervision and control departments and otherdepartments, and accept the democratic supervision from work union andemployees on work safety.

第十五条 生产经营单位的安全生产管理机构和安全生产管理人员负有下列职责:

(一)贯彻国家安全生产的法律、法规和标准;

(二)协助制订安全生产规章制度和安全技术操作规程;

(三)开展安全生产检查,发现事故隐患,督促有关业务部门及时整改;

(四)开展安全生产宣传、教育培训,总结和推广安全生产的经验;

(五)参与新建、改建、扩建的建设项目安全设施的审查,管理和发放劳动防护用品;

(六)组织编制本单位的生产安全事故应急预案,并定期开展演练;

(七)协助调查和处理生产安全事故,进行伤亡事故的统计、分析,提出报告;

(八)其他安全生产工作。

生产经营单位的安全生产管理机构负责人应当具有注册安全工程师资格或者相应的安全生产管理能力。

Article 15

The worksafety management organization and staff of production and business units exercisethe following duties:

1)    Fulfill the law, regulation and standard of national work safety;

2)    Aid to formulate the work safety regulations and work safetyoperation procedure;

3)    Carry out work safety check, find accident potential, and urge therelevant sector to rectify;

4)    Carry out the work safety publication, education and training, andsummarize and promote the experience of work safety;

5)    Take part in the safety facility check of construction project tobe built, renovated and expanded, manage and provide labor protection articles;

6)    Organize and draft the work safety accident rescue plan, and exerciseit regularly;

7)    Aid to investigate and treat work safety accident, make statisticsand analysis of casualty, and provide the report;

8)    Others of work safety.

Theresponsible of work safety management organization in production and businessunits shall have the qualification of registered safety engineer or have thecorresponding ability of work safety management.

第十六条 有下列情形之一的生产经营单位应当建立安全生产委员会,其他生产经营单位可以建立安全生产委员会:

(一)属于矿山、建筑施工和危险物品生产经营等高度危险性行业(以下简称高危行业)以及危险物品使用、储存、运输单位;

(二)属于金属冶炼、船舶修造、电力、装卸、道路交通运输等较大危险性行业(以下简称较大危险行业)的;

(三)从业人员三百人以上的。

生产经营单位的安全生产委员会由本单位的主要负责人、分管安全生产的负责人、安全生产管理机构及相关机构负责人、安全生产管理人员和工会代表及从业人员代表组成。

安全生产委员会审查本单位年度安全生产工作计划和实施、重大安全生产技术项目、安全生产各项投入等情况,研究和审查本单位有关安全生产的重大事项,督促落实消除事故隐患的措施。安全生产委员会至少每季度召开一次会议,会议应当有书面记录。

生产经营单位使用劳务派遣人员从事作业的,劳务派遣人员应当计入该生产经营单位的从业人员人数。

Article 16

Theproduction and business units in any of the following situations shall set upthe work safety committee, and other production and business units may set upthe work safety committee:

1)  units belonging to mining, construction and dangerous materialproduction and operation and other high-risk industry (hereinafter as “high-riskindustry”), and concerned to dangerous material use, storage andtransportation;

2)  belonging to the major-risk industry, including metal smelting,ship building, power, handling, road transportation and so on (hereinafter as “major-risk industry”);

3)  the employees are more than 300.

The worksafety committee is made by the principal responsible, responsible in charge ofwork safety, responsible of work safety management organization and relevantorganization, work safety management staff and representative of work union andemployees.

The worksafety committee shall check the situation of plan and implementation of annualwork safety, major project of work safety technology, all investment on worksafety and so on, study and check the major matter concerned to work safety,supervise and implement the measures eliminating the accident potential. Thework safety committee shall call at least one meeting each year, and thewritten minutes shall be kept.

 Where there are dispatched workers in productionand business units, the dispatched workers shall be counted into the employees.

第十七条 生产经营单位应当建立安全生产的检查、教育培训、奖惩以及设施设备安全管理、职业危害防治、劳动防护用品配备和管理、危险作业安全管理、特种作业管理、事故报告处理等规章制度。

Article 17

Productionand business units shall set up the regulations and system of work safetycheck, education and training, rewards and punishments and facility andequipment safety management, protection of occupational hazards, provision andmanagement of labor protection articles, safety management of dangerous work,special work management, accident report and treatment, etc.

第十八条 生产经营单位应当建立、健全安全生产责任制,明确各岗位的责任人员、责任内容和考核要求。

Article 18

Productionand business units shall establish and improve the work safety responsibilitysystem, clarify the responsible, content of responsibility and assessmentrequirements of each position.

第十九条 生产经营单位的决策机构、主要负责人或者个人经营的投资人应当保证安全生产所必需的资金投入,安全生产资金纳入年度生产经营计划和财务预算。

安全生产资金用于安全生产的技术项目、设施和设备,宣传、教育培训和奖励,劳动防护用品,安全生产的新技术、新工艺、新材料,重大危险源的监控和管理,应急救援器材、物资的储备,以及其他安全生产方面。安全生产资金不得挪作他用。

高危行业和较大危险行业的生产经营单位应当按照国家和本市有关规定建立安全生产费用管理制度,并于每年三月底前将本单位当年度安全生产费用提取、使用计划和上一年度安全生产费用提取、使用情况,报财政、安全生产监管部门备案。

Article 19

Thedecision-making body and principal responsible of production and businessunits, and investor of individual business shall assure the capital investment necessaryon work safety, the work safety fund shall be included in the annual productionand business plan and financial budget.

The worksafety fund shall be used in the technical project, facility and equipment,publication, education and training, and rewards of work safety, laborprotection articles, new technology, new skill and new material of work safety,supervision and management of major dangerous sources, storage of emergencyrescue equipments and supplies, and other field of work safety. The work safetyfund shall not be used for other purpose.

Theproduction and business units in high-risk industry and major-risk industry shallestablish the management system of work safety cost in accordance with therelevant provision of the State and this City, and file the withdrawal and useplan of work safety cost in the current year and the withdrawal and use situationof work safety cost last year to the finance and work safety supervisiondepartments for record within the end of every March.

第二十条 除法律、法规另有规定外,高危行业的生产经营单位,从业人员三百人以下的,至少配备一名专职安全生产管理人员;从业人员三百人以上的,至少配备三名专职安全生产管理人员;从业人员一千人以上的,至少配备八名专职安全生产管理人员;从业人员五千人以上的,至少配备十五名专职安全生产管理人员。

较大危险行业的生产经营单位,从业人员三百人以上的,至少配备两名专职安全生产管理人员;从业人员一千人以上的,至少配备五名专职安全生产管理人员;从业人员五千人以上的,至少配备十名专职安全生产管理人员。

前两款规定以外的其他生产经营单位,从业人员三百人以上的,至少配备一名专职安全生产管理人员;从业人员一千人以上的,至少配备两名专职安全生产管理人员;从业人员五千人以上的,至少配备五名专职安全生产管理人员。

Article 20

Unlessotherwise provided in the law and regulation, the production and business unitsin high-risk industry shall, provide at least one special staff of work safetywhere the employees are less than 300; provide at least 3 special staffs ofwork safety where the employees are more than 300; provide at least 8 specialstaffs of work safety where the employees are more than 1000; provide at least15 special staffs of work safety where the employees are more than 5000.

The productionand business units in major-risk industry shall, provide at least 2 specialstaffs of work safety where the employees are more than 300; provide at least 5special staffs of work safety where the employees are more than 1000; provideat least 10 special staffs of work safety where the employees are more than5000.

Otherproduction and business units, excluding mentioned in the above 2 paragraphs,shall provide at least 1 special staff of work safety where the employees aremore than 300; provide at least 2 special staffs of work safety where theemployees are more than 1000; provide at least 5 special staffs of work safetywhere the employees are more than 5000.

第二十一条 矿山、建筑施工单位和危险物品的生产经营单位的主要负责人和分管安全生产的负责人任职前应当参加安全培训,并经考核合格;其他生产经营单位的主要负责人和分管安全生产的负责人在任职三个月内,应当参加安全培训,并经考核合格。

安全生产管理人员任职前应当参加安全培训,并经考核合格。

Article 21

The principalresponsible and responsible in charge of work safety of mines, constructionunits and production and business units of dangerous articles shall participatein the safety training before taking the position, and pass the examination;Principal responsible and responsible in charge of work safety of other productionand business units shall participate in the safety training within 3 monthsafter taking the position, and pass the examination.

The worksafety management staff shall participate the safety training and pass theexamination.

第二十二条 生产经营单位应当对下列人员及时进行安全生产教育和培训:

(一)新进从业人员;

(二)离岗六个月以上的或者换岗的从业人员;

(三)采用新工艺、新技术、新材料或者使用新设备后的有关从业人员。

生产经营单位应当对在岗的从业人员进行定期的安全生产教育和培训。从业人员未经安全生产教育和培训合格的,不得上岗作业。

Article 22

Productionand business units shall provide the work safety education and training to thefollowing staff:

1)     new employees;

2)     employees who leave theposition more than 6 months or who change the position;

3)     relevant employees whilenew skills, new technology and new materials are adopted or after the newequipments are used.

Productionand business units shall provide regular work safety education and training tothe employee on the positions. The employee shall not be assigned to theposition where failing to pass the work safety education and training.

第二十三条 安全生产教育和培训内容主要包括安全生产的法律、法规和规章制度,安全操作基本技能和安全技术基础知识,作业场所和工作岗位存在的危险因素、防范措施以及事故应急措施,劳动防护用品的性能和使用方法以及其他需要掌握的安全生产知识。

安全生产教育和培训情况应当记入从业人员安全生产记录卡,记录卡应当由考核人员和从业人员本人签名。

安全生产教育和培训的时间按照国家和本市有关规定执行,费用由生产经营单位承担。

生产经营单位可以委托安全生产中介服务机构或者相关的行业组织实施安全生产教育和培训。

Article 23

The worksafety education and training mainly includes law, regulation and rule of worksafety, basic skills of safety operation and basic knowledge of safetytechnology, dangerous element of work location and position, protectionmeasures and accident rescue measures, performance and usage of laborprotection articles, and work safety knowledge needed to know.

The informationof work safety education and training shall be written in the record card ofstaff work safety, signed by the examiner and the employee.

The time ofwork safety education and training shall be implemented in accordance with the provisionsof the State and this Municipality, and the cost shall be taken by theproduction and business units.

Productionand business units can appoint the work safety intermediary organizations andrelevant industry organization to organize and carry out the work safety educationand training.

第二十四条 从事电工作业、焊接与热切割作业、高处作业、制冷与空调作业、冶金生产安全作业、危险化学品安全作业、烟花爆竹安全作业等特种作业的人员,应当按照国家有关规定经专门的安全作业培训,经考核合格取得特种作业操作资格证书后,方可上岗作业。

生产经营单位不得安排无特种作业操作资格证书的人员从事特种作业。

生产经营单位指派从业人员参加专门的安全作业培训和特种作业操作资格考试的,应当承担该从业人员的培训和考试费用,并可以与该从业人员订立协议约定服务期限。

Article 24

The specialworkers, concerned to electrical job, welding and thermal cutting, work atheights, refrigeration and air-condition, metallurgical production safetyoperation, dangerous chemicals safety operation, fireworks safety operation andso on, shall get special training in safe operation in accordance with relevantState regulations, and shall only be assigned to the position after obtainingthe qualification certificate for special operation

Productionand business units shall not assign the staff, without the qualificationcertificate for special operation, to the special position.

Productionand business units shall take the training and examination cost of employeewhere appointing the staff to participate in the work safety training and examinationof special operation qualification, and can make agreements on service termwith such employees.

第二十五条 矿山企业、建筑施工企业和危险化学品、烟花爆竹、民用爆破器材生产企业在生产前,应当依照《安全生产许可证条例》,向有关部门申请领取安全生产许可证。

用于生产、储存危险物品的建设项目的安全设施设计,在报送安全生产监管部门和专项监管部门审查时,应当提供安全条件论证报告和具有相应资质的机构出具的安全评价报告。审查部门对审查结果负责。

用于生产、储存危险物品的建设项目竣工正式投入生产或者使用前,安全生产监管部门和专项监管部门应当对项目中的安全设施进行验收。项目经验收合格后,方可正式投入生产和使用。

Article 25

Miningenterprises, construction enterprise and manufacture enterprises of dangerouschemicals, fireworks and civil blasting equipments shall, before theirproduction, apply the relevant work safety licenses before relevant departmentsin accordance with the Work Safety License Regulation.

The safetyfacility design of construction projects for the manufacture and storage ofdangerous articles shall provide the demonstration report of safety conditionsand the safety assessment reported issued by the qualified organization, whenfiling for examination before work safety supervision departments and specialsupervision departments. The examination department shall be responsible forthe results of the examination.

Before the constructionprojects for the manufacture and storage of dangerous articles formally carryout the production or are used, work safety supervision departments and specialsupervision departments shall check and accept the safety facility of theprojects. The projects can carry out the production and are use only afterchecked and accepted to be qualified.

第二十六条 生产经营单位应当对新建、改建、扩建生产、储存危险化学品的建设项目进行安全条件论证,并委托具有安全生产评价资质的中介服务机构进行项目安全评价。

生产、储存危险化学品的企业以及使用危险化学品从事生产的企业应当按照国家有关规定,委托具有安全生产评价资质的中介服务机构,对本企业的安全生产条件每三年进行一次安全评价,提出安全评价报告。安全评价报告应当包括对安全生产条件存在的问题进行整改的方案。

生产、储存危险化学品的企业以及使用危险化学品从事生产的企业应当及时将安全评价报告及整改方案的落实情况报安全生产监管部门备案。安全生产监管部门应当对安全评价报告及整改方案的落实情况进行抽查。

Article 26

Productionand business units shall make the safety condition demonstration on theconstruction projects for the manufacture and storage of dangerous chemicalarticles to be built, renovated or expanded, and appoint the intermediaryorganization with the qualification of work safety assessment to make theproject safety assessment.

The enterprisesof dangerous chemicals manufacture and storage and enterprise of usingdangerous chemicals in production shall, in accordance with the relevantprovisions of the State, appoint the intermediary organization with thequalification of work safety assessment to make the project safety assessmentfor the work safety conditions of their own enterprises every - year, providingthe safety assessment report. The rectification plan on the problems in worksafety conditions shall be included in the safety assessment report .

The enterprisesof dangerous chemicals manufacture and storage and enterprise of usingdangerous chemicals in production shall timely file the safety assessmentreport and implementation situation of rectification plan to the work safetysupervision departments for record. The work safety supervision departmentsshall do the spot check on the implementation situation of the safetyassessment report and the rectification plan.

第二十七条 生产经营单位应当按照国家有关规定办理重大危险源备案,并采取下列监控措施:

(一)建立运行管理档案,对运行情况进行全程监控;

(二)定期对设施、设备进行检测、检验;

(三)定期进行安全评价;

(四)定期检查重大危险源的安全状态;

(五)制定应急救援预案,定期组织应急救援演练。

生产经营单位可以委托具有相应资质的中介服务机构,对重大危险源进行检测和安全评价,并提出完善监控的措施。

生产经营单位应当至少每半年向安全生产监管部门和专项监管部门报告重大危险源的监控措施实施情况;发生紧急情况时,应当立即报告安全生产监管部门和专项监管部门。

  Article27

 

Productionand business units shall have the sources of grievous danger recorded, and takethe following supervisory measure:

1)    set up operation management files and wholly monitor the operation;

2)    conduct regular test and check on the facility and equipment;

3)    make regular safety assessment;

4)    regularly check the safety status of sources of grievous danger;

5)    make the emergency rescue plan and organize regular drills ofemergency rescue.

Productionand business units can appoint the intermediary organization with the relevantqualification to make the test and safety assessment on sources of grievousdanger, providing the measures to perfect the supervision.

Productionand business units shall report the implementation of supervision measures on sourcesof grievous danger to the work safety supervision department and special supervisiondepartment at least each half-year; when the emergency happens, it shall bereported to the work safety supervision department and special supervisiondepartment immediately.

第二十八条 生产经营单位进行爆破、大型设备(构件)吊装、危险装置设备试生产、危险场所动火作业、有毒有害及受限空间作业、重大危险源作业等危险作业的,应当按批准权限由相关负责人现场带班,确定专人进行现场作业的统一指挥,由专职安全生产管理人员进行现场安全检查和监督,并由具有专业资质的人员实施作业。

生产经营单位委托其他有专业资质的单位进行危险作业的,应当在作业前与受托方签订安全生产管理协议。安全生产管理协议应当明确各自的安全生产职责。

生产经营单位或者接受委托的作业单位在危险作业前应当制定危险作业的方案和安全防范措施,并设置作业现场的安全区域。

从事危险作业时,作业人员应当服从现场的统一指挥和调度,并严格遵守作业方案、操作规程和安全防范措施。

Article 28

When theproduction and business units engage in the dangerous activities, such asblasting, large equipment (components)lifting, trial production of dangerousequipments, hot work in dangerous place, poison and harmful work and refinedspace operation, sources of grievous danger, etc., it shall be leaded on thesite by the relevant responsible with the authorized duty, uniformly commandedby the confined special staff on the site, checked and supervised by thespecial work safety management staff, exercised by the staff with the specialqualification.

Whereproduction and business units appoint other units with special qualification tocarry out the dangerous activity, they shall sign the work safety managementagreement with the trustee before the work. The respective work safety duties shallbe specialized in the work safety management agreement.

Productionand business units and other authorized units shall, before the dangerous work,make the dangerous work plan and safety protection measures, and set up thesafety zone of work site.

During thedangerous work, the worker shall obey the unified direction and dispatch on thesite, and strictly comply with the work plan, operation procedure and safetyprotection measures.

第二十九条 生产经营单位为大型公共活动所设的临时性建筑物、构筑物及设施、设备的安全性能,应当经具有相应资质的机构检测、检验合格。

Article 29

The safetyperformance of temporary buildings, structures and facility and equipmentset-up by production and business units for large public events shall be testedand checked to be qualified by organization with relevant qualification.

 第三十条 生产经营单位不得将厂房、场所出租给不具备安全生产条件或者相应资质的单位或者个人。

生产经营单位出租厂房、场所给其他单位从事生产经营活动的,其出租的厂房、场所应当具备基本的安全生产条件,并书面告知承租人涉及厂房、场所安全的有关情况。租赁双方应当签订安全生产管理协议,明确双方对出租厂房、场所的安全管理责任。

出租方应当查验承租方所从事的生产经营范围,统一协调、管理同一区域多个承租单位的安全生产工作,加强对各承租人涉及厂房、场所安全行为的监督检查。发现承租方有安全生产违法行为的,应当及时劝阻并向所在地的安全生产监管部门和专项监管部门报告。

承租方应当严格遵守安全生产法律、法规,具备相应的安全生产资质和条件,并服从出租方对其安全生产工作的统一协调、管理。发生生产安全事故时,应当立即如实报告所在地的安全生产监管部门和专项监管部门。

Article 30

Productionand business units shall not lease the workshop and location to any unit orperson without work safety conditions or relevant qualifications.

Whereproduction and business units lease the workshop and location to other unitsconcerned to production and business, the leased workshop and location shallhave the basic work safety conditions, and the relevant information of workshopand location safety shall be notified to the lessee in writing. Both parties oflease shall sign the work safety management agreement, specifying both parties’safety management liabilities of workshop and location leased.

The leasershall check the management and business scope of the lessee, uniformly coordinateand manage work safety of the lease units in the same zone, strengthen the supervisionand check on the lessee’s safety conduct related to workshop and location. Wherefinding the lessee’s illegal conduct of work safety, it shall timely dissuadeand report to the local work safety supervision departments and special supervisiondepartments.

The lesseeshall strictly comply with the work safety law and regulation, have relevantwork safety qualification and conditions, and obey the unified coordination andmanagement on work safety from the leaser. When the work safety accidenthappens, it shall be reported the local work safety supervision departments andspecial supervision departments immediately.

第三十一条 生产经营单位应当为从业人员提供符合国家标准或者行业标准的劳动防护用品,并教育、督促从业人员正确佩戴、使用。生产经营单位不得以现金或者其他物品替代劳动防护用品的提供。

生产经营单位购买劳动防护用品时,应当查验产品质量合格证明;购买特种劳动防护用品时,还应当查验产品生产许可证和安全标志,并建立采购档案。

Article 31

Productionand business units shall provide to the employees labor protection articles inaccordance with the State standards or industry standards, and educate and urgethe employees to wear and use rightly. Production and business units shall notuse the case or other articles to replace the labor protection articles.

When buyingthe labor protection articles, production and business units shall check thequalification certificate of products; when buying the special labor protectionarticles, they shall check the qualification certificate of products and safetysigns and set up the purchase files.

第三十二条 存在职业危害的生产经营单位应当依法建立职业危害防治制度,包括职业危害的防治责任、告知、申报、宣传教育、防护设施维护检修、日常监测、从业人员体检以及职业健康监护档案管理等内容。

存在职业危害的生产经营单位应当按照国家有关规定,委托具有相应资质的中介服务机构定期进行检测和评价。检测和评价报告应当向从业人员公布,并报安全生产监管部门备案。

生产经营单位发生职业危害事故,或者发现职业病病人、疑似职业病病人的,应当及时向安全生产监管部门和有关部门报告。

Article 32

Productionand business units with occupational hazards shall set up the protection systemof occupation harm in accordance with law, including protection of occupationharm, informing, declaring, propaganda and education, maintenance of protectionfacility and equipment, daily monitoring, physical check of employees,supervision files management of occupational health and so on.

Productionand business units with occupational hazards shall, in accordance with therelevant provisions of the State, appoint the intermediary organization withrelevant qualification to make regular test and assessment. The test andassessment report shall be published to the employees, and is filed to the worksafety supervision departments for record.

Where thereare accidents of occupational hazards, or patients with occupational disease orsuspected patients with occupational disease, production and business unitsshall timely report to the work safety supervision departments and otherrelevant departments.

第三十三条 生产经营单位应当根据本单位的生产经营特点进行经常性的安全生产检查,定期进行专业性的安全生产检查,每月至少进行一次综合性的安全生产检查。

安全生产管理人员应当对检查中发现的事故隐患及时提出处理意见,跟踪事故隐患治理情况并记录在案。

Article 33

Productionand business units shall make the ongoing check of work safety in accordancewith the operation characteristics of their own units, and make the regularprofessional check of work safety, and make the whole check of work safety atleast one time each month.

The worksafety management staff shall timely provide the treatment opinion on theaccident potential found in the check, and trace the management of accidentpotential and record it in the files.

第三十四条 生产经营单位对本单位的生产安全事故隐患治理负全部责任,发现事故隐患的,应当立即采取措施予以消除;对非本单位原因造成的事故隐患,不能及时消除或者难以消除的,应当采取必要的安全措施,并立即向安全生产监管部门和专项监管部门报告。

安全生产监管部门和专项监管部门接到报告后,应当及时进行处理。在隐患排除前,安全生产监管部门和专项监管部门可以在生产经营场所的明显位置设置事故隐患提示标志。

Article 34

Productionand business units shall take all responsibility on the management of accidentpotential of their own, they shall immediately take measures to eliminate whenthe accident potential is found; if the accident potential not due to their ownunits fails to eliminated or is difficult to eliminated, they shall takenecessary safety measures and immediately report to the work safety supervisiondepartment and special supervision department.

After receivingthe report, the work safety supervision department and special supervisiondepartment shall timely dispose. Before eliminating the accident potential, thework safety supervision department and special supervision department shall putthe awareness sign on the obvious site of production and business location.

第三十五条 本市鼓励生产经营单位投保安全生产相关责任保险。

矿山、建筑施工、危险物品生产经营、道路交通运输、金属冶炼、船舶修造、装卸等行业的生产经营单位应当依照国家和本市的有关规定实行安全生产风险抵押金制度。发生生产安全事故时,原则上由企业先行支付抢险、救灾及善后处理费用,确实需要动用风险抵押金的,经安全生产监管部门和财政部门批准后,按照规定办理风险抵押金使用手续。生产经营单位投保安全生产相关责任保险的,经报送安全生产监管部门审核同意,可以免于存储安全生产风险抵押金。

Article 35

ThisMunicipality shall encourage that the production and business units apply forthe liability assurance related to work safety.

The productionand business units in the field of mines, construction, manufacture andoperation of dangerous articles, road transportation, metal smelting, shipbuilding and maintenance, handling, etc., shall adopt the deposit system ofwork safety risk in accordance with the relevant provisions of the State andthis Municipality. When the work safety accident happens, principally theenterprise shall pay the cost of rescue, relief and after-treatment firstly, ifthe risk deposit is necessary to use, the procedure of risk deposit use shallbe handled in accordance with the provisions after approved by the work safety supervisiondepartment and the finance department. If production and business units buy theliability policy related to work safety, the risk deposit of work safety can berelieved after filing to the work safety supervision departments for approval.

第三十六条 生产经营单位按照国家和本市有关规定开展安全生产标准化工作,并接受安全生产监管部门的指导。

Article 36

Productionand business units shall carry out the work safety standardization inaccordance with the relevant provisions of the State and this City, and acceptthe directions from the work safety supervision departments.

第三十七条 禁止生产经营单位及其有关负责人从事下列行为:

(一)指令或者放任从业人员违反操作规程或者安全管理规定从事作业;

(二)超过核定的生产能力、强度进行生产;

(三)隐瞒事故隐患,或者不及时处理已发现的事故隐患;

(四)违反操作规程或者安全管理规定从事作业;

(五)法律、法规规定的其他禁止行为。

Article 37

Production and business units and their responsible are prohibitedto do the followings:

1)    order or indulge the employees to work violating the operationrules or safety administration rules;

2)    produce beyond the production ability and intensity approved;

3)    conceal the accident potential, or fail to timely manage the accidentpotential found;

4)    work violating the operation rules or work safety administrationrules;

5)    others prohibited by the law and regulation.

                    第三章 从业人员的权利和义务

Chapter III  Rights andDuties of Employees 

第三十八条 生产经营活动中,从业人员享有下列权利:

(一)在集体合同、劳动合同中,载明劳动安全、防止职业危害和工伤保险等事项;

(二)了解其作业场所、工作岗位存在的危险因素及防范、应急措施;

(三)对本单位安全生产工作中存在的问题提出建议、批评、检举和控告;

(四)拒绝违章指挥、强令冒险作业的要求;

(五)发现直接危及人身安全的紧急情况时,停止作业或者在采取可能的应急措施后撤离作业场所;

(六)因生产安全事故受到损害后提出赔偿要求;

(七)接受安全生产教育和培训,掌握本职工作所必需的安全生产技能;

(八)获得生产经营单位提供的符合国家和行业标准的劳动条件和劳动防护用品;

(九)因接触职业危害因素接受符合国家有关规定的职业健康检查;

(十)法律、法规规定的其他权利。

Article 38

The employees have the following rights during the production andbusiness:

1)    indicate the matters related to work safety, protection ofoccupational hazards, injury insurance and others in collective contract andlabor contract;

2)    learn the dangerous element in the work location and position, andprotective and rescue measures;

3)    suggest, criticize, report and prosecute the problems in the worksafety of their own units;

4)    refuse to the illegal command and forced work;

5)    When finding the situation directly endangering the personalsafety, stop working, or take possible emergency measures and then leave thework location;

6)    Claim for compensation after damaged by the accident of worksafety;

7)    Obtain the labor conditions and labor protection articles inaccordance with the standards of the State and industry, provided by productionand business units;

8)    Accept the occupational health check in accordance with the provisionsof the State for touching the occupational hazards;

9)    Others provided by the law and regulation.

第三十九条 生产经营活动中,从业人员应当履行下列义务:

(一)严格遵守本单位的安全生产规章制度和操作规程;

(二)正确使用劳动防护用品;

(三)接受安全生产教育和培训;

(四)及时报告事故隐患和不安全因素;

(五)法律、法规规定的其他义务。

Article 39

The employees shall fulfill the following obligations during theproduction and business:

1)    Strictly comply with the work safety rule and operation procedureof their own units;

2)    Rightly use the labor protection articles;

3)    Accept the work safety education and training;

4)    Timely report the accident potential and unsafe elements;

5)    Others provided by law and regulation.

第四十条 生产经营单位使用劳务派遣人员从事作业的,应当将劳务派遣人员纳入本单位对从业人员安全生产的统一管理,履行安全生产保障责任,不得将安全生产保障责任转移给劳务派遣单位。

劳务派遣人员有依法向用工的生产经营单位主张安全生产的权利。

Article 40

Where production and business units have the dispatched workers,the dispatched workers shall be included in the unified management of employeework safety of their own units, take the protection liability of work safety,and shall not transfer the protection liability of work safety to the labor-dispatchingunits.

The dispatched workers are entitled to claim for the right of worksafety to the actual production and business units in accordance with the law.

第四十一条 安全生产监管部门和有关部门应当加强对从业人员发生事故伤害的预防工作。

本市工伤保险基金按照国家和本市的有关规定安排一定比例的费用,用于工伤预防的宣传、培训等。

Article 41

Work safety supervision departments and relevant departments shallstrengthen the protection on accidents of employees.

The municipal fund of injury insurance shall allot a certainpercentage in accordance with the relevant provisions of the State and thisMunicipality, for the propaganda and training of injury protection.

                      第四章 安全生产监督管理

Chapter IV: Supervision and Control over Work Safety

第四十二条 本市实行各级人民政府和有关部门安全生产行政责任制度。

市和区、县人民政府及其有关部门的主要负责人对本地区、本行业的安全生产管理工作承担主要责任,其他分管负责人按照职责分工依法承担相应责任。

Article 42

The administrativeliability system of work safety is applied to the people’s governments andrelevant departments at every level of this Municipality.

Theprincipal responsible of the municipal, district and county people’sgovernments and their relevant departments take the main liabilities of worksafety administration in the district and industry.

第四十三条 市和区、县人民政府应当对其所属部门和下级人民政府的安全生产工作进行年度考核,考核结果作为政府年度工作考核的重要依据。

市和区、县国有资产管理部门应当会同同级安全生产监管部门对其负责管理的国有企业的安全生产工作进行年度考核,考核结果纳入国有企业绩效考核。

Article 43

Themunicipal, district and county people’s governments shall make annualassessment on the work safety activities done by their subordinated departmentsand lower-level people’s governments. This assessment result shall be theimportant basis of government annual assessment.

The municipal,district and county state-owned asset administration departments, together withthe work safety supervision departments at the same level, shall make annualassessment on the work safety activities done by the state-owned enterprises administrated.This assessment result shall be included in the performance evaluation ofstate-owned enterprises.

第四十四条 市和区、县人民政府应当建立安全生产控制指标,对安全生产工作实行目标管理。

区、县人民政府和市有关部门每季度至少召开一次安全生产工作会议,分析本地区、本行业的安全生产形势和情况,研究、部署防范生产安全事故发生的措施和方案,协调并解决安全生产工作中的重大问题。

Article 44

Themunicipal, district and county people’s governments shall establish the controlindex of work safety, and provide the target management of work safety.

The districtand county people’s governments and relevant municipal departments shall holdthe work safety conference at least one time each quarter, analyzing thesituation and information of work safety in the district and industry, studyingand arranging the measures and plans of work safety accident prevention,coordinating and solving the major problems in the work safety.

第四十五条 产业园区管理机构应当确定负责安全生产监督管理的机构和人员,支持、督促、检查本园区内生产经营单位的安全生产工作,并协助有关部门实施安全生产监督管理。发现安全生产违法行为或者事故隐患的,应当责令生产经营单位立即改正或者限期治理,并向有关部门报告。

Article 45

Theadministration departments of industry zones shall define the institutions andpersonnel responsible for work safety supervision and administration, support,urge and examine the work safety of production and business units in the zones,and assist the relevant departments to carry out the supervision andadministration of work safety. If any illegal violation of work safety oraccident potential founded, they shall order the production and business unitsto correct immediately or manage within a time limit, and report to relevantdepartments.

第四十六条 乡、镇人民政府和街道办事处应当有相应机构和专门人员负责安全生产监督管理工作,对本辖区内高危行业和较大危险行业以外的生产经营单位实施安全生产日常检查,并协助有关部门实施安全生产监督管理。发现安全生产违法行为或者事故隐患的,应当向有关部门报告,并责令生产经营单位立即改正或者限期治理。

Article 46

Thetown-level people’s governments and neighborhood committees shall have thecorresponding institutes and special personnel in charge of the supervision andadministration of work safety, provide the daily checks to the production andbusiness units not in the field of high-risk and greater risk industry withinthe territory, and assist the relevant departments to carry out the supervisionand administration of work safety. If any illegal violation of work safety oraccident potential founded, they shall report to relevant departments and orderthe production and business units to correct immediately or manage within atime limit.

第四十七条 安全生产监管部门应当加强执法队伍的建设,依法开展行政执法工作。专项监管部门应当配置与其监督管理工作相适应的执法力量。

安全生产监管部门和专项监管部门应当定期对其执法人员开展安全生产技术知识、法律等方面的培训和考核。

Article 47

The worksafety supervision departments shall strengthen the construction of executiveteam, legally carry out the administrative enforcement. The special supervisiondepartments shall provide the executive staffs appropriate to their supervisionand administration.

The worksafety supervision departments and special supervision departments shall provideto their executive staffs regular training and assessment on technicalknowledge, laws of work safety and so on.

第四十八条 市和区、县人民政府应当组织安全生产监管部门和专项监管部门对生产经营单位建立和落实安全生产责任制、生产安全事故隐患排查治理、安全生产教育和培训等安全生产工作以及容易发生事故的生产、经营场所或者施工的设备、设施和场所进行安全生产检查。

安全生产监管部门和专项监管部门可以实行联合检查,并采用定期检查、随时抽查的方式,对生产经营单位进行安全生产检查。

市安全生产监管部门应当会同有关部门组织编制危险化学品、易燃易爆物品、重大危险源、压力容器等重点事项的监督检查计划,明确实施监督检查的部门、频次等,并建立相应的监督检查记录制度。

Article 48

Themunicipal, district and county people’s governments shall organize the worksafety supervision departments and special supervision departments to make thework safety check for production and business units on the work safety activitiesof establishment and implementation of work safety liability system,investigation and management of work safety accident potential, and work safetyeducation and training, and the production and business location prone toaccidents or the equipments, facilities and location of construction.

The worksafety supervision departments and special supervision departments can make thejointly check, and adopt the form of regular inspection and check at any time,and give the production and business units the work safety check.

Themunicipal work safety supervision departments shall, together with relevantdepartments, organize and formulate the supervision and inspection plan ofmajor items, such as dangerous chemicals, explosive and flammable articles,resources of gravies and pressure vessels, specify the supervision and inspectiondepartments, frequency, etc., and establish the corresponding file system ofsupervision and inspection.

第四十九条 安全生产监管部门和专项监管部门可以邀请专业技术人员和专家学者参与安全生产的监督检查、事故调查等工作,听取对专业技术问题的意见。

安全生产监管部门和专项监管部门应当建立、健全有关的专业技术人员和专家学者遴选、考核、奖酬、回避等制度。

Article 49

The worksafety supervision departments and special supervision departments can invitethe technical professionals, experts and scholars to participate thesupervision and inspection of work safety, accident investigation, etc., andlisten to the opinion on the special technology problems.

 The work safety supervision departments and specialsupervision departments shall establish and improve the system of selection, assessment,rewards, avoidance of technical professionals, experts and scholar.

第五十条 市安全生产监管部门会同有关部门组织编制安全生产重点监督管理单位目录,载明生产经营单位的名称、主要负责人姓名、监督管理部门以及监督管理的重点要求。

生产经营单位有下列情形之一的,应当列入安全生产重点监督管理单位目录:

(一)存在重大危险源的;

(二)存在重大事故隐患的;

(三)近三年内曾发生较大、重大或者特别重大生产安全事故的;

(四)市安全生产监管部门根据工作需要,认为有必要实行重点监督管理的其他情形。

Article 50

Themunicipal work safety supervision departments shall, together with relevantdepartments, organize and formulate the key unit list of work safety supervisionand administration, indicating the name of production and business unit, nameof principal responsible, supervision and administration department and majorrequirements of supervision and administration.

Theproduction and business unit shall be put on the key unit list of work safety supervisionand administration if any of the followings concerned:

1)    Resources of grievous danger;

2)    Grievous accident potential;

3)    Major, grievous or very grievous accident happened within 3 years;

4)    Other situations that the municipal work safety supervisiondepartments consider it necessary to put the key supervision and administrationin accordance with the work requirements.

第五十一条 生产经营单位存在重大生产安全事故隐患的,市和区、县人民政府应当指定有关部门督促生产经营单位制定、落实治理计划。

对于非生产经营单位原因造成,短时期内难以消除的重大生产安全事故隐患,市和区、县人民政府应当组织有关部门制定计划予以治理,并落实治理资金。任何单位和个人不得侵占治理资金或者挪作他用。

Article 51

If there isany grievous accident potential of work safety in the production and business units,the municipal, district and county people’s governments shall assign therelevant departments to urge the production and business units to formulate andimplement the management plan.

If thegrievous accident potential of work safety isn’t incurred by the production andbusiness unit and it is difficult to eliminate within a short term, themunicipal, district and county people’s governments shall organize relevantdepartments to formulate and handle, and find the management funds. Any unitand individual shall neither misappropriate the management funds nor use forother purpose.

第五十二条 本市建立重大危险源信息监管系统,对重大危险源实施市和区、县两级监管。

安全生产监管部门和专项监管部门应当按照国家有关规定实施重大危险源备案。

Article 52

Theinformation supervision system of resources of grievous danger shall be establishedthis Municipality, and the sources of grievous danger shall be supervised andadministrated by two levels of the municipality and district or county.

The worksafety supervision departments and special supervision departments shall makethe record of resources of grievous danger in accordance with the relevantprovisions of the State.

第五十三条 本市对危险化学品行业实行统一规划、合理布局和严格控制。

本市有关部门组织编制城乡规划,应当根据本市实际情况,规划专门用于危险化学品生产、储存的区域和禁止建设危险化学品生产、储存项目的区域。

在城乡规划禁止建设危险化学品生产、储存项目的区域内,已建的危险化学品生产、储存项目,由安全生产监管部门会同有关部门督促生产经营单位在规定期限内进行调整;需要转产、停产、搬迁、关闭的,由市或者区、县人民政府组织有关部门实施,并根据有关规定给予补贴。

市安全生产监管、经济信息化部门应当会同有关部门,制定本市危险化学品产业结构调整指导目录。

市安全生产监管部门应当会同市经济信息化、发展改革、公安、交通港口、环保等部门,制定本市禁止、限制、管控危险化学品生产、储存、经营、使用、运输等的目录。

Article 53

The industryof dangerous chemicals shall be uniformly planned, reasonably distributed and strictlycontrolled in this Municipality.

When therelevant departments organize and formulate the plan of town and country, thedistrict special for manufacture and storage of dangerous chemicals and thedistrict prohibited from the construction of manufacture and storage ofdangerous chemicals shall be planned in accordance with the actual situation ofthis Municipality.

If themanufacture and storage project of dangerous chemicals has already built in thedistrict prohibited from the construction of manufacture and storage ofdangerous chemicals in the plan of town and country, the work safety supervisiondepartments shall, together with the relevant departments, urge the productionand business units to modify. If the production convert, stop, transfer andclose are needed, it shall be implemented by the relevant departments organizedby the municipal, district and county people’s government, and the allowanceshall be provided as relevant provisions.

Thedepartments of municipal work safety supervision, economic information shall,together with relevant departments, formulate the guide catalog of dangerouschemical industry structure adjustment of this Municipality.

Themunicipal work safety supervision shall, together with the municipaldepartments of economic information, development and reform, public security,transportation port, environment protection, formulate the catalog ofmanufacture, storage, operation, use and transportation of dangerous chemicalsprohibited, restricted and controlled in this Municipality.

第五十四条 任何单位和个人发现生产经营单位存在重大事故隐患或者安全生产违法行为的,有权向安全生产监管部门和专项监管部门举报;对举报有功人员,由安全生产监管部门或者专项监管部门给予奖励。安全生产监管部门和专项监管部门应当为举报者保密。

本市对在改善安全生产条件、防止生产安全事故、参加抢险救护等方面取得显著成绩的单位和个人,给予奖励。

Article 54

Any unit orindividual, finding the grievous accident potential or illegal conduct of worksafety of production and business units, is entitled to report to the worksafety supervision departments and special supervision departments; themeritorious informant shall be awarded by the work safety supervisiondepartments and special supervision departments. The work safety supervisiondepartments and special supervision departments shall keep confidential for theinformants.

ThisMunicipality shall provide the awards to the unit and individual withsignificant achievements in improving the work conditions, preventing theaccident, participating in rescue and so on.

第五十五条 安全生产监管部门和专项监管部门应当通过电视、报纸、网络等媒体,对危害公共安全的安全生产违法行为及处理情况予以公布。

安全生产监管部门应当建立安全生产违法行为登录制度,在上海安全生产网上记载生产经营单位及其主要负责人、安全生产中介服务机构的有关违法行为及处理情况。任何单位和个人都有权进行查询。

Article 55

The worksafety supervision departments and special supervision departments shallpublish the illegal conduct endangering the public safety and the dispositionthrough the television, newspaper, internet and other media.

The worksafety supervision departments shall establish the registration system ofillegal conduct of work safety, indicating the production and business unit,its principal responsible, relevant illegal conduct of intermediaryorganizations and the disposition on the website of Shanghai Work Safety. Anyunit or individual is entitled to enquire.

                第五章 生产安全事故的应急救援和调查处理

   ChapterV:Accident Rescue, Investigation and Handling

第五十六条 生产经营单位应当制定生产安全事故应急救援预案,报安全生产监管部门和专项监管部门备案。

高危行业的生产经营单位应当建立安全生产应急救援组织,配备应急救援器材、设备并进行经常性维护、保养。其他生产经营单位应当明确负责应急救援的人员。

生产经营单位应当每年至少组织一次综合应急救援预案演练或者专项应急救援预案演练。高危行业、较大危险行业的生产经营单位,应当每半年至少组织一次综合应急救援预案演练或者专项应急救援预案演练。

Article 56

Productionand business units shall formulate the accident rescue plan of work safety andfile to the work safety supervision departments and special supervisiondepartments for record.

Productionand business units in the high-risk industry shall set up the accident rescueorganization of work safety, equip the materials and equipments of accidentrescue and keep ongoing repairing and maintenance. The other production andbusiness units shall specify the responsible staff of accident rescue.

Productionand business units shall organize the drills of comprehensive accident rescueor special accident rescue at least one time each year. The production andbusiness units in the high-risk and major risk industry shall organize thedrills of comprehensive accident rescue or special accident rescue at least onetime each half-year.

第五十七条 市和区、县人民政府应当建立、健全安全生产应急救援体系,根据本市突发公共事件总体预案,组织制定生产安全事故应急救援预案,确定应急救援队伍,储备应急救援物资、装备,加强安全生产应急救援资源共享和信息互通。

应急救援预案应当包括建立应急指挥体系,明确相关部门的应急救援职责,确定应急救援队伍,确定应急救援技术专家、建立抢险装备等信息数据库,确定交通、医疗、物资、经费、治安等保障措施,进行应急救援预案演练等。

Article 57

Themunicipal, district and county people’s governments shall set up and improvethe accident rescue system of work safety, in accordance with the municipal generalplan of public emergencies, organize and formulate the accident rescue plan ofwork safety, ensure the team of accident rescue, reserve the materials andequipment of accident rescue, and strengthen the resource sharing and commoninformation of accident rescue of work safety.

The accidentrescue plan shall include: set up the accident guide system, make clear theaccident rescue duties of relevant departments, define the team of accidentrecue, define the technical export of accident rescue, set up the database ofrescue equipments and so on, ensure the guarantee measures of transportation,medical, materials, funds, security, carry out the drills of rescue plan, etc.

第五十八条 生产经营单位发生生产安全事故后,应当在一小时内向安全生产监管部门和专项监管部门报告;情况紧急时,应当在三十分钟内向安全生产监管部门和专项监管部门报告。

安全生产监管部门和专项监管部门应当逐级上报事故情况。每级上报均应当在一小时内完成口头上报,在两小时内完成书面上报。

Article 58

After theaccident of work safety happens, the production and business unit shall reportto the work safety supervision departments and special supervision departmentswithin one hour; if any emergency, shall report to the work safety supervisiondepartments and special supervision departments within 30 minutes.

The worksafety supervision departments and special supervision departments shall reportthe accident by levels. The report at each level shall be done in oral within 1hour and within 2 hours in writing.

第五十九条 生产安全事故发生后,生产经营单位应当立即启动相应的应急救援预案,迅速采取有效措施,组织抢救,防止事故扩大,减少人员伤亡和财产损失;市或者区、县人民政府以及安全生产监管部门、相关专项监管部门接到事故报告后,应当立即组织事故救援。

Article 59

After theaccident of work safety happens, production and business units shallimmediately activate the respective recue plans, raptly take effectivemeasures, organize the rescue, prevent the accident from expansion, reduce thecasualties and property losses; the Municipality and district and county people’sgovernment and work safety supervision departments and relevant special supervisiondepartments shall instantly organize the accident rescue after receiving theaccident report.

第六十条 除法律、行政法规另有规定外,本市发生的生产安全事故按照下列规定进行调查:

(一)重大和较大生产安全事故,由市人民政府负责调查,市人民政府可以授权或者委托市安全生产监管部门或者其他有关部门组织调查;

(二)一般生产安全事故,由事故发生地区、县人民政府负责调查,区、县人民政府可以授权或者委托区、县安全生产监管部门或者其他有关部门组织调查。

市人民政府认为必要时,可以调查区、县人民政府负责调查的事故。

Article 60

Unlessotherwise provided by the law and regulation, the accident of work safetyhappened to this Municipality shall be investigated as the followings:

1)    Grievous or major accident shall be investigated by the municipalpeople’s government, and the municipal people’s government can authorize orappoint the municipal work safety supervision department and other relevantdepartments to organize the investigation.

2)    Ordinary accident shall be investigated by the district and countypeople’s government where the accident happens, and the district and countypeople’s government authorize or appoint the district or county’s work safetysupervision department and other relevant departments to organize theinvestigation.

Themunicipal people’s government can investigate the accident that the districtand county people’s government takes charge to investigate, when it isconsidered as necessary by the municipal people’s government.

第六十一条 安全生产监管部门应当定期统计分析本行政区域内发生生产安全事故的情况,并定期向社会公布。

生产经营单位发生重大生产安全事故或者一年内发生两次以上较大生产安全事故,且对事故发生负有主要责任的,安全生产监管部门应当会同有关部门向社会公告,并向市发展改革、规划国土资源、建设交通、经济信息化以及金融监管等部门通报有关情况。

Article 61

The worksafety supervision departments shall make regular statistics and analysis on thework safety accident happens within their territory, and make it publicregularly.

If the productionand business unit has the grievous accident, or two and more major accidents inone year, and takes the main responsibility, the work safety supervisiondepartment, together with relevant departments, shall make it public, andreport the relevant information to the department of municipal development andreform, planning and land resources, construction and transportation, economyand information, finance administration, etc.

                           第六章 法律责任

Chapter VI:Legal Responsibility

第六十二条 违反本条例规定的行为,《中华人民共和国安全生产法》及其他有关法律、法规已有处罚规定的,依照其规定处罚;构成犯罪的,依法追究刑事责任。

生产经营单位发生生产安全事故,造成他人人身、财产损害的,依照有关法律,承担赔偿责任。

Article 62

Any conductviolating these Regulations shall be punished according to what provided in theLaw of People’s Republic of China on Work Safety and other relevant law andregulation; if it constitutes a crime, it shall be investigated for thecriminal liability.

If productionand business units have the work safety accident and damage others’ personaland property, it shall take the compensation liability in accordance withrelevant law.

第六十三条 生产经营单位违反本条例第十九条第三款的规定,未将安全生产费用的有关情况报送备案的,由安全生产监管部门责令限期改正;逾期未改正的,处以五千元以下的罚款。

Article 63

Ifproduction and business units violate what provided under Paragraph 3 ofArticle 19 hereof, failing to file the relevant information of work safety costfor record, it shall be ordered by the works safety supervision department torectify within a time limit; if failing to do so within the time limit, theyshall be fined less than 5,000.

第六十四条 生产经营单位未按照本条例第二十条规定配备专职安全生产管理人员的,由安全生产监管部门责令限期改正;逾期未改正的,责令停产停业整顿,并可以依法处以罚款,罚款额按未配备安全生产管理人员人数计,每少配备一人罚款五千元。

Article 64

Ifproduction and business unit fails to provided the special work safetymanagement staff as provided under Article 20 hereof, it shall be ordered bythe work safety supervision department to rectify within a time limit; iffailing to do so within the time limit, it shall be ordered to suspendproduction or business operation for shake-up, and also be fined in accordancewith law, the amount shall be calculated on the number of work safetymanagement staff to provide, 5,000 per person to be provided.

第六十五条 生产经营单位主要负责人、分管安全生产的负责人、安全生产管理人员未按照本条例第二十一条的规定参加安全培训并经考核合格的,由安全生产监管部门责令限期改正;逾期未改正的,处以五千元以上二万元以下的罚款。

Article 65

If theprincipal responsible, responsible in charge of work safety and work safety managementstaff fail to participate the safety training and pass the examination asprovided under Article 21 hereof, they shall be ordered by the work safety supervisiondepartment to rectify within a time limit; if failing to do so within the timelimit, they shall be fined more than 5,000 and less than 20,000.

第六十六条 生产经营单位违反本条例第二十二条的规定,未对从业人员进行安全生产教育培训的,由安全生产监管部门责令限期改正;逾期未改正的,责令停产停业整顿,并可以依法处以罚款,罚款额按未培训从业人员人数计,每少培训一人罚款五百元。

Article 66

Productionand business units violate what provided under Article 22 hereof, failing to providethe work safety education and training to the employees, it shall be ordered bythe work safety supervision department to rectify within a time limit; iffailing to do so within the time limit, it shall be ordered to suspendproduction or business operation for shake-up, and also be fined in accordancewith law, the amount shall be calculated on the number of the employees withouttraining , 500 per person.

第六十七条 生产经营单位违反本条例第二十八条第二款、第三款的规定,从事危险作业未签订安全生产管理协议,或者未设置作业现场安全区域的,由安全生产监管部门责令改正,并可以对生产经营单位和接受委托的作业单位处以五万元以上二十万元以下的罚款。

Article 67

Productionand business units violate what provided under Paragraph 2, 3 Article 28 hereof,carrying out dangerous activities without signing the work safety managementagreement or without setting the safe zone on the work site, it shall beordered by the work safety supervision department to rectify, and theproduction and business units and the authorized units shall be fined more than50,000 and less than 200,000.

第六十八条 矿山、建筑施工、危险物品生产经营、道路交通运输、金属冶炼、船舶修造、装卸等行业的生产经营单位违反本条例第三十五条的规定,未足额存储安全生产风险抵押金且未投保安全生产相关责任保险的,由安全生产监管部门责令限期改正;逾期未改正的,处以一万元以上三万元以下的罚款。

Article 68

The productionand business units in the field of mines, construction, manufacture andoperation of dangerous articles, road transportation, metal smelting, shipbuilding and maintenance, handling, etc., violate what provided under Article35hereof, failing to keep the risk deposit of work safety and failing to buythe relevant liability policy of work safety, it shall be ordered by the worksafety supervision department to rectify within a time limit; if failing to doso within the time limit, it shall be fined more than 10,000 and less than30,000.

第六十九条 生产经营单位及其有关负责人违反本条例第三十七条第一项至第四项的规定,从事禁止行为的,由安全生产监管部门对生产经营单位处以一万元以上三万元以下的罚款,对其有关负责人处以一千元以上一万元以下的罚款。

Article 69

The productionand business units and their relevant responsible violate what provided underPoint 1-4 of Article 37 hereof, carrying out the prohibited activities, the productionand business units shall be fined by the work safety supervision departmentmore than 10,000 and less than 30,000, and the relevant responsible shall befined more than 1,000 and less than 10,000.

第七十条 各级人民政府及其有关部门的工作人员有下列情形之一的,依照《中华人民共和国公务员法》、《中华人民共和国行政监察法》等法律、法规,追究行政责任;构成犯罪的,依法追究刑事责任:

(一)未按照规定履行安全生产监督管理责任的;

(二)因其失职、渎职行为造成重大生产安全事故隐患的;

(三)发生生产安全事故,未按照规定组织救援或者玩忽职守致使人员伤亡或者财产损失扩大的;

(四)对生产安全事故隐瞒不报、谎报或者拖延报告的;

(五)阻挠、干涉生产安全事故调查处理或者生产安全事故责任追究的。

Article 70

The staff ofpeople’s government and their relevant departments shall be investigated forthe administrative liability in accordance with the Law of People’s Republic ofChina on Civil Service and the Law of People’s Republic of China onAdministrative Supervision, if any of following concerned; if it constitutes acrime, it shall be investigated for the criminal liability:

1)    Fail to fulfill the duty of work safety supervision and control asprovided;

2)    Cause the grievous accident potential of work safety due todereliction of duty or malfeasance;

3)    When accidents of work safety happen, fail to organize the rescueor  dereliction of duty, incurring thepersonnel injuries or property damages expanded;

4)    Conceal, lie or report in delay the accident of work safety;

5)    Obstruct or intervene the investigation and disposition of worksafety accident or the investigation for the liability of work safety accident.

第七十一条 当事人对安全生产监管部门或者专项监管部门的具体行政行为不服的,可以依照《中华人民共和国行政复议法》或者《中华人民共和国行政诉讼法》的规定,申请行政复议或者提起行政诉讼。

当事人对具体行政行为逾期不申请复议,不提起诉讼,又不履行的,作出具体行政行为的安全生产监管部门或者专项监管部门可以申请人民法院强制执行。

Article 71

If the partyconcerned refuses to accept the specific administrative act of work safety supervisiondepartments or special supervision departments, it can apply for theadministration review or file the administrative litigation in accordance with theLaw of People’s Republic of China on Administrative Review or the Law of People’sRepublic of China on Administrative Litigation.

If the partyconcerned doesn’t apply the administrative review, nor file the administrativelitigation, nor make the enforcement within the time limit, the work safetysupervision departments or special supervision departments releasing thespecific administrative act can make a request to the People’s court forenforcement.

                             第七章 附则

Chapter VII Supplementary Provisions

第七十二条 本条例下列用语的含义是:

(一)生产经营单位,是指从事生产经营活动的企业、个体工商户以及其他能够独立承担民事责任的经营性组织。

(二)生产经营单位主要负责人,是指生产经营单位的法定代表人和实际负有本单位生产经营最高管理权限的人员。

(三)产业园区,是指依法设立并由市或者区、县人民政府派出或者指定机构管理的工业园区、高新技术产业开发区、保税区和出口加工区。

(四)危险物品,是指易燃易爆物品、危险化学品、放射性物品等能够危及人身安全和财产安全的物品。

Article72 

Thefollowing terms herein are defined as below:

1)     Production and businessunit means the enterprise and individual-owned business, engaging in productiveand operative activities, as well as other profitable organization that cantake the civil liability independently.

2)     Principal responsible of productionand business unit means the legal representative of the production andoperation unit and the staff who actually have the supreme administrative poweron the production and operation of such unit.

3)    Industry zone means the industry park, high technology andindustry development zone, high-tech industry development zone, bonded zone andexport processing zone legally set-up and dispatched or appointed by themunicipality and district and county people’s governments.

 

4)    Dangerous articles include materials that present potential threatto the safety of persons and property safety, such as combustibles andexplosives, hazardous chemical materials and radioactive substances.

第七十三条 国家机关、事业单位、人民团体、民办非企业单位在日常运营中的安全作业管理,参照执行本条例。法律、法规另有规定的,从其规定。

Artocle73

 The state departments, institutions, people’s organization,private non-enterprise units shall apply these Regulations for reference.  Where otherwise is provided in the law andregulations, such regulations shall prevail.

第七十四条 本条例自201211日起施行。

Article 74

 These Regulations shall be implemented sinceJanuary 1, 2012.
